Looking back 30 years, a few EPs stand out.
The recent refinery EP showed that targeting a sector works.
WE would have never gone in to them otherwise.
The Cranes collapses have seemed to fade away.
Media + OSHA + outrage works.
Las Vegas is quiet.
WE are not seeing anything coming at us that jumps out.
It is like fate is spinning the death wheel randomly.
Is this the sign of the bottom?
Are WE that successful and ready to pack to go home?

OSHA's Strategic Plan
The Boxman reached into the trashcan.
There it was.
OSHA's Strategic Plan 2006-2011.
He wonder if he read it all.
Apparently not.
He must not have cared.
The Boxman sighed.
His team worked many hours to make it a comprehensive product.
To set out a thoughtful vision of the agency's future.
Now it is like yesterday's news.
He wondered if anyone cared.
He picked the plan up.
He would keep it.
You never know when history repeats itself.
WE agree the Boxman.
OSHA needs a new strategic plan.
They need a permanent leader first.
Then it will change.
Then a new Strategic plan will come out.
So that the public can see.
That there is long term planning.
Maybe it will be proactive.
Maybe it will dump the SST.
Target by sectors.
Offer no incentive to lie.
This is the lull before the storm.
Look at the news.
Old issues still come up.
Falls.
Asphyxiation.
Collapses.
It is just different players.
The big stick is getting attention.
ASSE was a revolution.
An OSHA head that does not hide.
An OSHA head that will listen.
Keep it up.
It is working.
The contest rate seems to be going up.
Everyone wants their day in court.
As long as they win.
50 and free is the chant in the offices.
50 inspections and they will back off of you.
So easy.
So clear.
Yet there is no quota.
Only for the Double AD and AD.

The Texas Tornado Cometh

US Department of Labor Secretary Hilda L. Solis plans a constructive safety initiative in Texas to prevent workplace injuries and fatalities, she told a meeting of the American Society of Safety Engineers.
The Occupational Safety and Health Administration will implement the construction safety initiative. Solis said more workers die on construction jobs in Texas than in any other state. This involves all types of construction work, including oil and gas projects and expansions. Statistics show 67 fatalities in Texas construction last year and 33 so far this year, Solis said.
“Beginning in July, OSHA will increase the number of inspectors in Texas for a concentrated effort to prevent injuries and fatalities at construction sites,” Solis said. “When these inspectors observe unsafe scaffolds, fall risks, trenches, or other hazards, they are empowered to launch an immediate investigation.”
Solis told reporters after her speech that she is dissatisfied with OSHA’s current reputation and that she wants “to see a turn to the respect that OSHA needs.” She emphasized repeatedly that DOL is willing to work with businesses.
She is requesting a department budget request that would enable OSHA to hire 130 new inspectors and 25 more discrimination investigators.

Why Johnnie can't cite anything
The old days, we were measured on how much WE cited.
WE still have appraisals that showed how many violations, inspections, willful citations WE issued.
Senator Kennedy didn't like that.
He got the OSHA Act changed to no numbers in the late 80's.
No penalties.
It sounded like a good idea.
OSHA ignored it.
It never applied to the double AD and the Area Directors.
It never has.
The cabal loves the quota.
Always quality over quantity they say.
Yet WE hear differently.
"Bring in the numbers."
This forces the newbie Cshos to get it done fast.
"It is Thursday, aren't you done with that complaint?"
They want three violations an inspection.
"Get that penalty up higher" said the double AD.
WE were told by four successive OSHA heads to not cite posters and trivial stuff.
Trivial stuff like record keeping.
"Don't waste your time on an Other violation."
Now recordkeeping is a problem.
It has come full circle.
The same double ADs, that are chastising the meek and slow, never go out.
You heard us right.
They never go out.
No one counts that number.
Why is that?
Most managers are comfortable with their chair.
They are desk jockeys coaching from afar.
They are actually proud of themselves.
They live to criticize the mistakes.
For the people who don't get them what they want.
But there are exceptions.
WE know who they are.
They seem to perform miracles.
Managers without exception.
Manager who ignore their cabal.
They work underground.
For the workers.
For the complainants.
For doing the right thing.
Whilst Rome burns elsewhere.
Anyhoo.

Such a short tour of duty, yet another million dollar case.
It doesn't take a genius.
Money talks.
Everyone watches the big cases.
No one watches the small fry $50k cases.

Government Accounting Office Criticizes OSHA on VPP
That will be the headlines this week.
OSHA didn't follow its own rules.
OSHA didn't look at the companies after fatalities.
OSHA is inconsistent.
And it really doesn't matter.
The VPP companies are the most powerful safety organization now.
It has a life of its own.
The ones we met have been good.
Too bad more companies don't have that attitude.
The agency will announce a comprehensive look at all these non enforcement program.
It will be an excuse to cut these further.
WE know different.
They want that super super secret goal of 40,000 inspection.
More than anything.
They want alot from us.
Ever feel like your are a cog or a trained monkey?
The field is tired.
Run, Spot run.
Vini, vidi, vici.
The September farce of inspections will begin as usual.
Did you really expect anything would change?
Just audit these September inspections.
Just once.
Then you will see.
But they don't understand.
As if changing the top portraits makes a difference.
The real question that the GOA missed was not even looked at.
Do the VPP companies lie on their records to get in?
Who is going to look when you needed your quota for your office.
Who is going to look when you see those that miss the quota get whipped.
Quotas everywhere.
Congress is to blame.
See OSHA smile, they think VPP is their friend.
See VPP smile, they are glad OSHA is fooled.
Who exploits who?

Wal-mart and the General Duty Clause

Where is the General Duty Clause?
So WE can learn.

Why is it so hard to put these General Duty Clause violations up?
History repeats itself.
If you want to be proactive, OSHA is not helping you.

Crowd managers were not provided any prior crowd management training or the necessary tools to safely manage a large crowd of approximately 2000 customers; on or about 11/28/08. They had to create a $400,000 victims' compensation fund.
Also $1.5 million to Nassau County social services programs and nonprofit groups.
The OSHA fine was $7,000.
For one life.
There will not be a criminal prosecution.
The deal was made.
Walmart said. "We consider Mr. Damour part of the Wal-Mart family, and are saddened by his death"
The victim's father said "It's like if they were driving a car and they hit someone, killed him and then just walked away,"
The Victim had been hired by an employment agency as a temporary worker.
He had been on the job about a week when he died.

The Heat is on Sunoco
Explosion rocks Sunoco chemical refinery

Do they care?
21 inspections since 2000 with affirmed PSM violations.
146 affirmed PSM standards against them.
A couple of willfuls PSM citations.
Only one was coded EEP.
And let me repeat ourselves.
Only was coded an EEP.
The Serious VIP program will fail.
The same cabal that managed the EEP is running this SVIP.
They are clueless.
And you thought Cintas was bad.
And you thought the IG was hard on you.
Sunoco illustrates the lack of critical thinking at the top.
Not the new guy.
The old cabal.
They are still chasing numbers.
That super super secret 40,000 inspection goal.
If you thought you were behind in the quota....
Now you got another dozen or so to do too.
The beatings will continue.
WE pulled out an inspection file for Sunoco.
The CSHO was told to deal with only items in plain sight.
WE haven't got time to do a comprehensive.
WE have plenty of time to go back again and again.
When will WE learn...
WE posted about Sunoco as recently as May 10.
It is like they are good for an annual SIG.
And lord knows we need to get 100 Sigs a year.
Eventually, time will stop and an employee will die.
All in the name of doing quotas.

So should we get away from total inspection numbers? I wouldn't mind it and I'm sure there are ADs who would like too as well, but inspection numbers are easy for Congress to understand and the unions point to them all the time, so I don't see them going away.

It certainly is not the stimulus.
It certainly is not quotas.
WE can watch the hours spent in the field.
WE can do more follow ups and require OSHA 300 data be sent for a few years.
WE will watch companies change after inspections.
Some were bad and saw the light.
They changed the culture.
They implemented safety and health committees.
Unlike us.
When ED made those goals.
With no input from the field.
These reformed companies are the best in the sector.
Truly a revolution...

So should we get away from total inspection numbers? I wouldn't mind it and I'm sure there are ADs who would like too as well, but inspection numbers are easy for Congress to understand and the unions point to them all the time, so I don't see them going away.

It certainly is not the stimulus.
It certainly is not quotas.
WE can watch the hours spent in the field.
WE can do more follow ups and require OSHA 300 data be sent for a few years.
WE will watch companies change after inspections.
Some were bad and saw the light.
They changed the culture.
They implemented safety and health committees.
Unlike us.
When ED made those goals.
With no input from the field.
These reformed companies are the best in the sector.
